FMLA

On August 5, 1993, the “Family and Medical Leave Act” became effective nationwide. Hamra Enterprises, will comply with all aspects of this act. Employees of Hamra Enterprises, will be granted up to 12 weeks of unpaid leave during a 12-month period for certain family and medical reasons provided the employee meets the eligibility requirements.

 

The poster in the restaurant lists the reasons for taking family and medical leave but does not fully explain a serious health condition. A serious health condition means any illness, injury, impairment, physical or mental condition which involves inpatient care in a hospital, hospice or residential medical care facility, or continuing treatment by a health care provider. If the reason given is due to a serious health condition, you will be required to provide timely and sufficient medical certification from a qualified health care provider. Period of medical disability would require absence from work of more than three consecutive days.

 

On January 28, 2008, President Bush signed into law the National Defense Authorization Act for Fiscal Year 2008 (“NDAA”) (H.R. 4986).  Section 585 of the NDAA amends the federal Family and Medical Leave Act of 1993 (“FMLA”) to provide two new types of FMLA leave to employees with family members serving in the military. Chicago Bread complies with all aspects of this addition.

 

If it becomes necessary for the employee to apply for family and medical leave, please obtain a request form from the benefit coordinator at the home office in Springfield, Missouri. If possible, the form should be completed 30 days in advance of the effective date of the requested leave. When the need for leave is foreseeable, such as planned medical treatment, the employee must make an effort to schedule the leave so as not to disrupt company operations. While on leave, the employee will be required to report periodically on their leave status and intentions regarding return to work.

 

Employees are required to use any unused vacation pay for absences.

 

Employees who are currently enrolled in group insurance coverage and are granted an approved leave of absence under this policy must pay their premium amount during the period of the unpaid absence to ensure no disruption in their coverage.

 

*Massachusetts Only-The Department of Family and Medical Leave oversees the Commonwealth’s Paid Family and Medical Leave (PFML) program. This program provides temporary income replacement to eligible workers who are welcoming a new child into their family, are struck by a serious illness or injury, need to take care of an ill or ailing relative, and for certain military considerations.
